WORKSHOP TERMS, LIABILITY WAIVER & IMAGE USAGE AGREEMENT
NYC Photo Workshop on August 15-16, 2026
By registering for, purchasing access to, or attending the New York City Photography Lighting Workshop hosted by Brett Garamella LLC (“Organizer”), I acknowledge that I have read, understood, and agreed to the following terms:
1. EDUCATIONAL WORKSHOP & ACCEPTANCE OF TERMS
This workshop is an educational instructional program focused on photography, lighting, composition, directing subjects, and cinematic portrait creation.
My participation is entirely voluntary. By completing registration or attending the workshop, I enter into a binding agreement with Organizer.
Participants must be at least 18 years old to attend.
A workshop seat is not reserved until full payment has been successfully received and processed.
2. ASSUMPTION OF INHERENT RISK
I understand that photography workshops conducted in active urban environments inherently involve risks that cannot be completely eliminated regardless of care taken by Organizer.
I knowingly and voluntarily assume all risks associated with participation, including but not limited to:
walking through public streets and sidewalks
traffic and transportation hazards
changing weather conditions
crowded public environments
studio and lighting equipment usage
lifting or carrying photography gear
slips, falls, fatigue, or physical exertion
theft, loss, or damage to personal property
actions of participants, pedestrians, or third parties
unforeseen city conditions or operational disruptions
I understand these risks are inherent to participation in an on-location photography workshop and voluntarily choose to participate despite such risks.
3. LIABILITY WAIVER & RELEASE
To the fullest extent permitted by law, I waive, release, and hold harmless Brett Garamella LLC, Brett Garamella, assistants, contractors, instructors, hired talent, affiliated studios, venue owners, and related parties from any and all claims, liabilities, damages, losses, costs, or expenses arising from my participation in the workshop, including claims based on ordinary negligence.
This waiver does not apply to gross negligence, reckless conduct, or intentional misconduct where prohibited by law.
To the fullest extent permitted by law, Organizer’s total liability arising from workshop participation shall not exceed the total amount paid by Participant for the workshop.
4. PERSONAL PROPERTY
I am solely responsible for my own safety, equipment, and belongings at all times.
Organizer is not responsible for loss, theft, or damage to:
camera bodies
lenses
memory cards
hard drives
computers
phones
lighting equipment
luggage
cash
personal items
whether in transit, on location, in studio spaces, or elsewhere.
5. IMAGE USAGE, STREET PHOTOGRAPHY & COMMERCIAL RESTRICTIONS
During the workshop, I may photograph hired professional models and athletes, members of the public, and fellow attendees.
Permitted Use
I retain copyright ownership of the images I personally create during the workshop.
I may use those images for:
portfolio use
professional websites
social media
editorial submissions
photography competitions
self-promotional purposes
Commercial Restrictions
I understand that copyright ownership and commercial usage rights are separate legal concepts.
I may not commercially license, sell, distribute, publish, monetize, or exploit images captured during the workshop for:
advertising campaigns
paid brand partnerships
stock photography
merchandise
commercial print sales
client campaigns
endorsements
commercial sponsorships
unless I independently obtain all required:
model releases
property releases
permits
licenses
legal permissions
Organizer is not responsible for securing commercial usage rights for attendees.
Consent to Be Photographed
I understand that I may appear in photographs or video captured by Organizer or fellow attendees during the collaborative workshop environment.
I consent to the use of my likeness, image, and voice for:
workshop documentation
educational materials
portfolio use
social media
promotional and marketing purposes
without compensation or further approval.
6. BEHIND-THE-SCENES RECORDING
I understand Organizer may photograph, film, livestream, or record the workshop and participants.
I grant Organizer the irrevocable, perpetual, worldwide, royalty-free right to use my likeness, image, voice, and appearance in behind-the-scenes, promotional, educational, editorial, and marketing materials in any media now known or later developed without compensation or further approval.
7. PAYMENT, CANCELLATION & REFUND POLICY
Due to the limited-capacity nature of the workshop and upfront production expenses involving studios, models, assistants, travel, and logistics, the following refund policy applies:
Cancellations more than 60 days before the workshop: refund minus a $150 non-refundable deposit
Cancellations 30–59 days before the workshop: 50% refund
Cancellations within 30 days of the workshop: non-refundable
Transfers to another attendee may be requested with at least 48 hours written notice, subject to Organizer approval.
Failure to attend does not entitle Participant to a refund or credit.
8. FORCE MAJEURE & ITINERARY CHANGES
Organizer reserves the right to modify:
shooting locations
schedules
instructors
models
studio access
itinerary
workshop format
due to weather, illness, transit disruptions, protests, emergencies, venue issues, government restrictions, force majeure events, or other operational circumstances beyond Organizer’s reasonable control.
Such changes do not entitle Participant to refunds, credits, or damages.
9. PROFESSIONAL CONDUCT
I agree to behave respectfully, responsibly, and professionally toward Organizer, fellow attendees, hired talent, venue staff, and the public.
Organizer may remove me from the workshop without refund if my behavior is:
unsafe
disruptive
harassing
threatening
intoxicated
illegal
excessively intrusive
damaging to the workshop environment or reputation
10. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless Organizer from any claims, liabilities, damages, losses, costs, or attorney fees arising from:
my actions or omissions
my violation of laws or regulations
my misuse of images
my breach of these terms
my violation of privacy, publicity, licensing, or intellectual property rights
11. MEDICAL & EMERGENCY RESPONSIBILITY
I certify that I am physically and mentally capable of participating in the workshop.
I understand Organizer does not provide medical care, health insurance, travel insurance, or emergency services.
I authorize Organizer to contact emergency medical personnel if necessary and accept full financial responsibility for any resulting treatment or transportation.
12. GOVERNING LAW & VENUE
This agreement shall be governed by the laws of the State of New York.
Any disputes arising from workshop participation or this agreement shall be resolved exclusively in the state or federal courts located in New York County, New York.
13. SEVERABILITY
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
14. ENTIRE AGREEMENT & ELECTRONIC ACCEPTANCE
This agreement constitutes the entire agreement between Participant and Organizer regarding workshop participation and supersedes prior discussions or representations.
Electronic acceptance, online registration, digital signatures, or checkbox acknowledgements shall have the same legal effect as a physical signature.
By registering for or attending the workshop, I confirm that I have read, understood, and voluntarily agreed to these terms.
